TERMS OF SERVICE

Welcome to RECO SKINLAB! The terms “we”, “us” and “our” refer to RECO SKINLAB S.L. (“RECO SKINLAB”). We operate this store and website, including all related information, content, features, tools, products and services (the “Services”). The Services are hosted by Shopify.
These Terms of Service (“Terms”) set out your rights and obligations when using the Services. By visiting, interacting with or using the Services, you agree to be bound by these Terms and our Privacy Policy and Cookie Policy. If you do not agree, do not use the Services. Nothing in these Terms affects your mandatory consumer rights under EU and Spanish law.

Section 1 - Access and accout
By agreeing to these Terms, you confirm you are at least the age of majority in your country/region and have capacity to contract. To use the Services (including placing orders), you may need to provide accurate and complete information (e.g., email, billing, payment and shipping details) and keep it up to date. You are responsible for maintaining the confidentiality of your credentials and for all activity under your account. Accounts are personal and non-transferable.

Section 2 - Our products
We aim to provide accurate product information (including INCI ingredient lists, nominal content, PAO/batch codes and usage warnings where applicable). Colours/appearance may vary due to device settings. We do not warrant that any product will fully meet your subjective expectations; however, your statutory guarantee for lack of conformity applies. Product descriptions, pricing and availability may change at any time; we may limit quantities per person/household/region as needed.

Section 3 - Orders
Your order is an offer to purchase. The contract is formed when we confirm acceptance by email and we have received payment. We may refuse or cancel an order (e.g., stock errors, pricing mistake, suspected fraud). If cancelled after payment, we will refund you. Please review your order carefully before submitting. Your purchases are for personal/household use and not for resale/export. Returns and withdrawals are governed by our Return and Refund Policy.

Section 4 - Prices and billing
Prices shown at checkout include applicable VAT for EU consumers unless otherwise indicated. Shipping, handling, duties or import charges (if any) are disclosed before you complete the purchase. Promotions may have separate terms; if they conflict with these Terms, promotion terms prevail for that promotion. You authorise us and our payment providers to charge your selected payment method for the order total. Provide accurate billing/shipping details and keep them current.

Section 5 - Shipping and delivery
Delivery estimates are indicative and not guaranteed. We are not responsible for delays caused by carriers, customs or events beyond our control. Risk passes when you (or a person you designate) physically receive the goods (not when handed to the carrier).

Section 6 - Intellectual property
The Services (including trademarks, designs, text, images, graphics, video/audio, look & feel and code) are owned by RECO SKINLAB or its licensors and protected by applicable laws. You may use the Services for personal, non-commercial purposes only. No rights are granted except as necessary to browse and purchase. Shopify and other third-party names/logos are trademarks of their respective owners.

Section 7 - Optional tools
We may provide access to third-party tools “as is” and “as available” without warranties or endorsements. Your use of such tools is at your discretion and subject to the third party’s terms/policies.

Section 8 - Third-party links
The Services may contain links or integrated content from third parties. We are not responsible for examining or evaluating, and we do not warrant, third-party content or sites. Access and use them at your own risk. Review their terms and privacy policies before engaging in any transaction.

Section 9 - Relationship with Shopify
RECO SKINLAB is powered by Shopify, which enables provision of the Services. Purchases are made directly with RECO SKINLAB. Shopify is not responsible for your transactions with us. You expressly release Shopify and its affiliates from claims, damages and liabilities arising from such transactions, without prejudice to your statutory rights against RECO SKINLAB.

Section 10 - Privacy policy
Personal data we collect through the Services is processed in accordance with our Privacy Policy and, where applicable, Shopify’s privacy documentation. Because the Services are hosted by Shopify, certain data is processed by Shopify and its subprocessors (which may be located outside your country). See our Privacy & Cookies Policy for more information and your GDPR rights.

Section 11 - Feedback
If you submit reviews, ideas or feedback (“Feedback”), you grant us a non-exclusive, transferable, sublicensable, worldwide, royalty-free licence to use, reproduce and publish such Feedback in connection with the Services and our marketing, in accordance with applicable laws (including advertising transparency). You warrant you have the necessary rights and that your Feedback complies with these Terms. We may moderate or remove unlawful/offensive content.

Section 12 - Errors, inaccuracies and omissions
From time to time there may be information on the Services that contains typographical errors, inaccuracies or omissions (e.g., descriptions, pricing, shipping charges, availability). We reserve the right to correct and update such information or cancel orders based on it, as permitted by law.

Section 13 - Prohibited uses
You agree not to use the Services unlawfully or in ways that harm the Services, us or others (e.g., transmitting malware, scraping, attempting unauthorised access, spamming, infringing IP rights, harassing staff). We may suspend or terminate access where reasonably necessary to protect the Services or comply with law.

Section 14 - Termination
We may terminate or suspend access to the Services at any time for breach or where required by law. You remain liable for amounts due up to the termination date. Sections that by nature should survive (including Intellectual Property, Feedback, Privacy, Legal Guarantee/Consumer Rights, Liability, Indemnity, Governing Law) will survive.

Section 15 - Disclaimer of warranties
Except as required by mandatory consumer law and the legal guarantee for lack of conformity, the Services are provided “as is” and “as available”. We do not warrant uninterrupted, timely, secure or error-free operation. This clause does not limit rights that cannot be waived.

Section 16 - Limitation of liability
Nothing in these Terms excludes or limits liability that cannot be excluded under applicable law (including liability for death/personal injury caused by negligence, fraud, or your statutory consumer rights for lack of conformity). Subject to that, we are not liable for indirect/consequential losses or losses not reasonably foreseeable. Your statutory rights remain unaffected.

Section 17 - Indemnification
You agree to indemnify and hold harmless RECO SKINLAB and our affiliates, officers, employees, agents, contractors and service providers from third-party claims arising from your unlawful use of the Services or breach of these Terms, to the extent permitted by law.

Section 18 - Severability
If any provision is found unlawful, void or unenforceable, it will be enforced to the maximum extent permitted and the remainder will continue in full force.

Section 19 - Waiver; Entire agreement
Failure to enforce any right is not a waiver. These Terms and policies referenced herein are the entire agreement between you and us regarding the Services, superseding prior versions.

Section 20 - Assignment
You may not assign or transfer your rights or obligations under these Terms without our written consent. We may assign or transfer our rights/obligations as permitted by law.

Section 21 - Governing law
These Terms are governed by Spanish law and applicable EU consumer protection rules. Disputes will be submitted to the courts of the consumer’s place of residence. The European Commission’s ODR platform is available at https://ec.europa.eu/odr.

Section 22 - Headings
Headings are for convenience only and do not limit these Terms.

Section 23 - Changes to terms of services
You can review the current version at any time on this page. We may update these Terms; material changes will be notified as required by law. Continued use after the effective date constitutes acceptance.
